1. Agreement
These Terms of Service ("Terms") are a binding agreement between you and Storbor Inc. ("Storbor", "we", "us"). By creating an account or using the Storbor apps or storbor.com (the "Services"), you agree to these Terms, our Privacy Policy, Acceptable Use & Prohibited Items Policy, Cancellation & Refund Policy, and, where applicable, the Storbor Guarantee Terms and Pickup & Return Service Terms, all of which are incorporated by reference.
2. What Storbor is (and isn't)
Storbor is a marketplace that connects Custodians (who offer space) with Renters (who book space), plus an optional Storbor-operated Pickup & Return service. Except for the Pickup & Return service, Storbor is not a party to the storage arrangement between a Custodian and a Renter, does not own or control listed spaces, and is not a warehouse, bailee, mover, or insurer. Storbor does not guarantee the condition, safety, legality, or availability of any space or the conduct of any member. Access during custody is set by the Custodian. A space may be check-in / check-out only (no access while stored); any in-and-out (visit) access is granted at the Custodian's discretion and is shown in the listing.
3. Eligibility and accounts
- You must be 18 or older and able to form a binding contract.
- You must provide accurate information and complete identity verification to book or host.
- You are responsible for your account and for keeping your credentials secure.
- We may refuse, suspend, or terminate accounts that violate these Terms or pose a risk.
4. Bookings
- A booking is for a stated space, time window (minimum one hour), and declared items. The Renter must accurately declare what is being stored.
- Every listing and every booking is assigned a unique reference code (e.g.
L-7QK3MD,B-92HXTW) shown in the app for support and dispute purposes. - The exact address is shared with the Renter after a confirmed booking.
- Custodians set availability and may block dates; Renters may book only available slots.
- Both parties agree to follow the space's stated rules and access arrangements.
- Check-in (drop-off) is required to start custody. If a Renter does not check in by the booking's start time, Storbor reminds the Renter hourly and alerts the Custodian for up to 8 hours, after which the booking is automatically cancelled as a no-show — the Custodian is not paid and the Renter's storage charge is refunded (service fee non-refundable). - Renters store at their own risk. Storbor and Custodians are not insurers, and the optional Storbor Guarantee is not insurance. You are responsible for the legality of what you store, and you are strongly encouraged to carry your own insurance for goods of meaningful value. You must not store anything on the prohibited-items list; a Custodian may refuse or report a booking that breaks these rules.
- Unpaid storage. If a Renter fails to pay amounts owed, the stored goods may be subject to the Custodian's lien, and — only after the notice and waiting period required by law (e.g., Ontario's Repair and Storage Liens Act) — may be sold to satisfy the debt, with any surplus returned to the owner. Custodians may not seize or sell goods outside that legal process.
5. Pricing, fees, and payments
- Storbor uses all-in pricing: the price a Renter sees is the Custodian's rate plus an 8% Renter service fee, displayed as "price + applicable taxes," with a breakdown shown before booking. Optional add-ons (e.g., Storbor Guarantee, Pickup & Return) are shown separately at checkout.
- The 8% Renter service fee is charged to the Renter on every booking and covers secure payments, support, dispute resolution, and platform operation.
- Storbor charges Custodians a commission of 13% of the booking, deducted from the Custodian's payout. We may change fees on prospective notice.
- All platform fees (the Renter service fee, the Custodian commission, and any Storbor Guarantee upgrade fee) are non-refundable on a Renter-initiated cancellation. See the Cancellation & Refund Policy.
- Payments are processed by Stripe. By transacting, you agree to Stripe's terms.
- Payouts to Custodians are made through our payment processor after the applicable hold/clearing period. You are responsible for your own taxes.
6. Conduct and prohibited use
You agree to use the Services lawfully and to follow the Acceptable Use & Prohibited Items Policy. You may not store prohibited, illegal, hazardous, or dangerous items, or use a space for anything other than lawful storage of declared items.
7. Reviews and content
You may post listings, photos, messages, and reviews ("User Content"). You keep ownership but grant Storbor a non-exclusive, worldwide, royalty-free licence to host, display, and use User Content to operate and promote the Services. Content must be accurate, lawful, and non-infringing. We may remove content that violates these Terms.
8. Cancellations, refunds, and disputes
Cancellations and refunds are governed by the Cancellation & Refund Policy. Members should first try to resolve disputes directly; Storbor may, but is not obligated to, help mediate. Storbor Guarantee claims follow the Storbor Guarantee Terms.
9. Trust and safety
We verify member identity and provide tools (documented drop-off/pick-up photos, ratings, messaging, reporting) to support safe transactions, as described in the Trust & Safety Policy. We do not guarantee any member's conduct.
10. Disclaimers
The Services are provided "as is" and "as available." To the fullest extent permitted by law, Storbor disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free.
11. Limitation of liability
To the fullest extent permitted by law, Storbor and its directors, officers, and employees will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Except for the Pickup & Return service and any amounts payable under the Storbor Guarantee, Storbor's total liability for any claim is limited to the greater of (a) the commissions Storbor earned on the booking(s) at issue, or (b) CAD $100. Some jurisdictions do not allow certain limitations; in those cases the limitations apply to the maximum extent permitted.
Your consumer rights are not waived. Nothing in these Terms (including this section, the disclaimers in §10, or the indemnity in §12) excludes, restricts, or modifies any condition, warranty, guarantee, right, or remedy you have under the Ontario Consumer Protection Act, 2002 or other applicable consumer-protection law that cannot lawfully be excluded or limited. Where such a right applies and cannot be excluded, our liability is limited only to the extent the law permits. The limitations above are intended to apply primarily to business users and otherwise to the maximum extent the law allows.
12. Indemnity
You agree to indemnify and hold Storbor harmless from claims, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your User Content, your stored items, or your breach of these Terms or the law.
13. Suspension and termination
We may suspend or terminate your access for violations, risk, or legal reasons. You may stop using the Services and close your account at any time. Sections that by their nature should survive (e.g., 5, 10–14) survive termination.
14. Governing law and disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there. The courts located in Ontario have jurisdiction, subject to any non-waivable consumer-protection rights you have under applicable law.
15. Changes
We may update these Terms. Material changes will be notified in-app or by email and take effect on the stated date. Continued use after changes means you accept them. Version history is tracked in our internal Policy Register.
